6. Proprietary Methodology and Prohibited Uses
The EEV Framework, the TRUMP scorecard, and all associated reporting structures, code bases, and interface layouts are the exclusive intellectual property of EEV Analytics LLC. Subscription access provides a limited, non-exclusive, non-transferable license to utilize this research solely for authorized, informational internal business or personal use.
Users are strictly prohibited from reselling, publicly redistributing, copying, or bulk exporting any EEV reports, metrics, or data. Furthermore, utilizing web scrapers, automated scripts, bots, or data-extraction tools to systematically replicate or harvest content from this platform is explicitly forbidden and constitutes a material breach of these terms.
7. Custom Research and Report Lifespan Rules
Custom research or valuation reports generated through a premium member workspace are subject to a strict one-year (365-day) private exclusivity window from the date of creation. During this period, the report remains private and accessible only via the requesting member's secure account panel.
Following the expiration of this 365-day window, all generated reports automatically enter the public domain to build a long-term educational historical archive. EEV Analytics LLC retains the absolute right, at its sole discretion, to remove privacy restrictions and make these historical reports available to all membership tiers, the general public, and public search engine indexes. When a report converts to public status, all personal identifiers of the original creator are permanently stripped, ensuring 100% user anonymity forever. Unauthorized commercial replication or resale of these reports during or after the exclusivity period is strictly prohibited.
8. Account Security and Access Controls
Premium workspace access is restricted to authenticated subscribers only. Users are entirely responsible for maintaining the security of their individual identification codes, profile access links, and passwords. Sharing login credentials to grant non-members access to private tracking dashboards or active research modules is a violation of these terms and may result in immediate suspension or termination of the account by EEV Analytics LLC without a refund.
9. Limitation of Liability
In no event shall EEV Analytics LLC, its managers, members, employees, affiliates, or its data providers be liable under any contract, tort, negligence, strict liability, or other legal or equitable theory for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, loss of profits, trading losses, or investment deficits) resulting from the use of, or the inability to use, the information, webhooks, or automation tools on this site. You assume full, uncompromised responsibility for your investment decisions and any resulting financial outcomes.
10. Severability and Choice of Law
If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, that specific provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will stay in full force and effect. These terms shall be governed by, tracked, and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising under these terms shall be brought exclusively in the federal or state courts located within the State of California.
